Building permits have been issued for the lands at Church Street and Hoghway 401, according to the Town of Ajax.
“The subject lands have been developed in accordance with the Minister’s Zoning Order (MZO) and all necessary approvals (approval of Site Plan Application SP1/22) and building permits have been issued,” it said in an issued notice.
The last hurdle prior to developing the lands is By-law Number 52-2020 which was passed by Town of Ajax Council on December 7, 2020 to regulate the future development of the subject lands, municipally known as 221, 271, and 321 Church Street South.
However, By-law Number 52-2020 was appealed to the Ontario Land Tribunal, and following the appeals, the Ministry of Municipal Affairs and Housing issued a Minister’s Zoning Order (O. Reg. 773/21) on November 15, 2021 to regulate the future development of the subject lands, reflective of By-law Number 52-2020.
The town now intends to repeal By-law Number 52-2020, as a result of which the appeals will be withdrawn and the MZO regulating the subject lands will remain in full force and effect, said the town.
A copy of the staff report and repealing by-law will be available by end of day on Tuesday, October 8 in the agenda for the October 15 General Government Committee meeting, available at ajax.ca/meetings. Alternative formats of documents and materials can be made available upon request in order to assist those who require accessibility accommodations, the town said.
The repeal of the by-law will be considered by Town of Ajax Council at its meeting on Monday, October 21.
