Brock repeals own ATV bylaw, implements HTA rules

The Township of Brock has announced that as of February 27, 2023, ATV Bylaw 1954-2005-PP had been repealed by the township council.

Operation of off-road vehicles (ORVs) in Brock will now follow Ontario Regulation 316/03 under the Highway Traffic Act and subject to enforcement by local police.

It spelled out the law (as below).

Legal Requirements for On-Road Riding

  • Driver must be 16 years of age and hold a valid G2, M2 licence
  • Driver must carry the registration permit
  • No passengers under the age of 8
  • Driver and passengers must wear an approved, secured helmet
  • Drives and passengers must be seated and belted properly
  • Passengers on 2-up ATVs must be able to reach and use the footrests provided

Legal Requirements for ATVs/ORVs

  • ATV/ORV must be registered, have a rear licence plate and must be insured
  • ATVs cannot exceed the manufacturer’s overloading warning label when travelling on-road
  • Side-by-sides and UTVs must not exceed the width and weight requirements of the manufacturer
  • Must be driven in the same direction of the traffic on the shoulder of the road with all lights on.
  • If the shoulder is unsafe, impassable or not wide enough so all tires can be completely on the shoulder, then the travelled portion of the road may be used.

Brock explained that enthusiasts can ride under MTO regulation in Ontario on provincial highways 500-899, many 7000 series highways, and highways with low traffic volume.

ORV driving is not permitted on 400 series highways, QEW, and sections of the Trans-Canada Highway.

Enthusiasts cannot also drive Off-Road Vehicles (ORV) where there is no bylaw in place and/or the municipality is not listed under Ontario Regulation 8/03.

The township said in Brock, you cannot ride on Durham Region roadslike River Street, Sunderland, Cameron Street, Cannington. However, you are permitted to cross Regional Roads at a 90 degree angle.

Driving is also not permitted on Highway 7, Highway 48, and Highway 12, but you are permitted to cross provincial roads at a 90 degree angle.

Speed regulations:

  • 20kmh is the maximum speed an ATV can travel on roads with a posted speed limit of 50kmh or less.
  • 50kmh is the maximum speed an ATV can travel on roads with a posted speed limit of more than 50kmh.
  • Municipalities may set lower speed limits or additional rules for ATVs.
