Business-friendly changes to Oshawa Plan

Oshawa has made some key business-friendly changes to its Official Plan to take into consideration the new normal under the ongoing pandemic.

Oshawa Council has enacted By-law 118-2020 to make a number of city-initiated amendments to Zoning By-law 60-94 which consist of the following:

  • Amending Section 2 of the Zoning By-law by amending the definition of Home Occupation to permit food preparation services;
  • Amending Section 2 of the Zoning By-law by amending the definition of Self-Serve Storage Building to also permit secure document storage;
  • Amending Section 5 of the Zoning By-law by deleting and replacing Article 5.2.6 to permit multiple group homes on a lot subject to the number of persons collectively residing in all of the group homes on a lot not exceeding a maximum of ten;
  • Amending Section 27 of the Zoning By-law by amending Article 27.1.2 to delete Industrially Oriented Office and Professional Office as permitted uses and add Office as a permitted use, to have the effect of permitting all types of Office uses in the Prestige Industrial and Select Industrial Zones; and,
  • Amending Section 28 of the Zoning By-law by amending Sentence 28.3.15(1) to delete Eat-in restaurant as a permitted use and add Restaurant as a permitted use, to have the effect of permitting all types of Restaurant uses in the SI-A(11) Select Industrial

The Official Plan Amendment 198 to the City of Oshawa Official Plan was passed by the Council of the City of Oshawa on the 14th day of December, 2020, said an announcement.

It said the proposed Official Plan Amendment is exempt from approval by the Region of Durham. The decision of council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

The last day for filing a notice of appeal is January 13, 2021.

The council announcement said the the purpose and effect of Amendment 198 to the Oshawa Official Plan is to delete Policy 2.2.10.6. This policy is no longer required for the subject lands as they were re- designated from Special Purpose Commercial to Residential through Official Plan Amendment 196 to the Oshawa Official Plan.

The land to which the Official Plan Amendment applies is also the subject of a separate application under the Planning Act for an amendment to the City’s Zoning By-law 60-94 under File Z-2019-09.
