The 440-unit condo complex nearing completion at 51 and 55 Clarington Boulevard in Bowmanville, has applied to remove the municipal ‘hold’ on the property.
“The Municipality of Clarington has received a request from Fifty Five Clarington Ltd. to amend Zoning By-Law 84-63 to remove a Hold (H) symbol from the Urban Residential Exception (R4-44) Zone on a site located at 51 and 55 Clarington Boulevard, Bowmanville,” said a municipal statement.
Council has given the Deputy CAO of Planning & Infrastructure Services delegated authority to approve the removal of holding symbols and related by-laws, as established by By-Law 2001-072 and amended by By-Law 2023-014.
Since the conditions for removal have been met for the site plan application (SPA2017-0005), the Deputy CAO plans to pass an amendment to Zoning By-law 84-63, on or after October 17, the statement said.
An ‘H’ holding symbol is a tool used to ensure specific conditions are met before land development can proceed according to the approved zoning. Once the conditions are met, the municipality must remove the holding symbol if the landowner requests it and passes a by-law.
The Development Review Division has confirmed the ‘H’ holding symbol is in place to ensure:
- Archaeological clearance to the satisfaction of the Ministry of Tourism Culture and Sport.
- An updated Noise and Vibration Impact Study has been prepared to the satisfaction of CP Railway and Metrolinx, including any recommendations and mitigation techniques in the site plan design and development agreement, to the satisfaction of the Region of Durham.
- An updated Phase 1 Environmental Site Assessment and sign off from a Qualified Professional for Environmental Site Assessment is to the satisfaction of the Region of Durham.
- Appropriate arrangements are made for the provision of the signed site plan agreement associated with SPA2017-0005 to serve this development are fulfilled.
The Planning and Infrastructure Services Department is satisfied that the conditions for lifting the holding symbol have been met to facilitate the development of a multi-residential building.
