Even as the City of Oshawa fines and issues notices to buildings around Memorial Park, no statement has been forthcoming on who will secure the park itself.
On September 25, Oshawa Masonic Hall was issued a violation notice under the nuisance bylaw. The hall borders the park – like does the Canadian Automotive Museum (CAM) which has been fined $1,500 for a similar violation,
The bylaw states “no person shall cause, create or permit a nuisance in any public place in the city”.
Homeless Creating Nuisance
The notice said: “There are groups of unsheltered individuals that frequent the property, who have been observed regularly causing nuisance activity within direct public view. Nuisance activity includes, but is not limited to loitering, yelling, screaming, littering, and other unpleasant disorderly, or obnoxious behavior on the property.
It asked the hall to “discontinue causing, creating, or permitting the above-mentioned nuisance activity on the property. Compliance can be achieved by providing consistent preventative security measures.”
Potential Fines and Clear-up Costs
The city notice said: “You are hereby ordered to comply with the aforementioned by-law by taking the appropriate action to eliminate the violation on or before October 02, 2026 at 8 am.”
It went on to say if the hall failed to comply with the requirements of the above-noted By-law by the compliance date and time stated, the City of Oshawa may carry out the required work at the owner’s expense. The cost of carrying out the work will be invoiced to the property owner and, if unpaid after 30 days, all expenses incurred will be added to the tax roll and collected from an owner in the same manner as municipal taxes.
It said failure to comply with this order may also result in administrative penalties or penalties
as prescribed by the Provincial Offences Act.
